Digital Hosting will credit
your account for the fees paid for any month in which an unplanned service
interruption occurs due to failure of a Digital owned server or other
equipment. An unplanned interruption is defined as any consecutive 10 minute
period of site inaccessibility for which a customer did not receive 24 hours
prior e-mail notification.
Digital Hosting is not responsible for
interruption resulting from non-Digital owned equipment, Network
Solutions related issues, customer installed applications or scripts, Acts
of God, or "Denial of Service" attacks on Digital Hosting or its customer's
website.
Any Refunds issued are issued as credits to the customers
account. Refunds are issued upon request of the customer and upon determination
by Digital Hosting that a Service Interruption has occurred. All requests for
refunds must be made, in writing, to Digital Hosting within thirty days of the
Service Interruption.
Digital Hosting is not responsible for damages,
loss of profits, sales, or any other indirect cost related to any Service
Interruption. In no event will Digital Hostings liability for Service
Interruptions exceed the total amount paid for service for one
month.
